Terms & Conditions

These Terms and Conditions govern the use of our website and the provision of care services by Orivane. By accessing our website or entering into a care arrangement with us, you accept these terms in full. Please read them carefully before proceeding.

1. Definitions

"Orivane" / "We" / "Us" / "Our" refers to the residential care facility operating at 77 Moo 6, Nong Kham, Si Racha, Chonburi 20110, Thailand.

"User" / "You" refers to any individual who accesses our website or engages with our care services, including family members and representatives acting on behalf of a senior.

"Resident" refers to a senior individual receiving care under one of Orivane's service programmes.

"Services" refers to Home Visit Care, Full Residence, and Specialized Nursing Residence as offered by Orivane.

"Agreement" refers to the care contract entered into between Orivane and the client or authorised representative upon commencement of a service.

2. Acceptance of Terms

By accessing this website or submitting an enquiry, you confirm that you are at least 18 years of age and have the legal capacity to enter into agreements. If you are acting on behalf of a senior family member or under power of attorney, you confirm that you are authorised to do so.

Use of this website implies acceptance of these Terms and Conditions and our Privacy Policy. If you do not agree, please discontinue use of the website.

3. Services Provided

Orivane provides three tiers of elderly care services within the Chonburi province of Thailand: Home Visit Care (฿11,000/month), Full Residence (฿35,500/month), and Specialized Nursing Residence (฿61,000/month). A full description of each service is available on our Solutions page.

Services are available to residents of Thailand and to international families arranging care for a senior in the Chonburi region. Services are delivered in English and Thai.

The availability of specific services is subject to capacity at the time of enquiry. Orivane reserves the right to suspend or adjust service offerings in response to operational or regulatory requirements.

4. Care Agreements and User Responsibilities

Prior to commencing a care arrangement, Orivane and the client (or authorised representative) will enter into a written care agreement specifying the scope of services, fees, and responsibilities of both parties. Nothing on this website constitutes a formal care agreement.

Clients and family representatives are responsible for providing accurate and complete information about the senior's health, medical history, and personal needs at the time of assessment and as circumstances change during the care period.

Users of this website agree not to use it for any unlawful purpose, to attempt to gain unauthorised access to any part of the site or its systems, or to transmit harmful, offensive, or misleading content through any enquiry form.

5. Fees and Payment

Monthly fees for each service tier are stated in Thai Baht (THB) and are subject to change with reasonable notice. The care agreement will specify the agreed fee, payment schedule, and any applicable additional charges (such as specialist consultations arranged at a family's request beyond the standard programme).

Monthly invoices are issued in advance. Payment is due within 7 days of the invoice date. Orivane accepts payment by bank transfer and other methods as agreed in the care contract.

Refunds for services already delivered are not available. In cases of service termination, fees are calculated pro-rata for the period of active care, subject to the terms of the individual care agreement.

6. Intellectual Property

All content on this website — including text, layout, design, images, and branding — is the property of Orivane or is used with appropriate permission. You may not reproduce, redistribute, or commercially exploit any content from this website without our prior written consent.

You are granted a limited, non-exclusive licence to access and view this website for the purpose of enquiring about our services.

7. Disclaimers

This website is provided for informational purposes only. While we make every effort to keep information accurate and current, Orivane does not warrant the completeness, reliability, or suitability of any content for your specific circumstances.

The information on this website does not constitute medical or clinical advice. Families should seek independent medical guidance when making care decisions. Orivane does not make claims about specific health outcomes for residents.

8. Limitation of Liability

To the fullest extent permitted by Thai law, Orivane's liability to any party in connection with the use of this website or the provision of care services is limited to the fees paid for the relevant service in the preceding calendar month.

Orivane is not liable for indirect, incidental, or consequential loss arising from reliance on information provided on this website. This limitation does not apply to liability arising from gross negligence, fraud, or wilful misconduct by Orivane staff in the course of delivering care.

9. Termination of Care

Either party may terminate a care arrangement by giving 30 days' written notice, subject to the terms of the individual care agreement. In cases where continued care poses a risk to the safety of the resident, other residents, or staff, Orivane reserves the right to terminate with shorter notice.

Upon termination, any outstanding fees for services delivered are due. The resident's personal belongings will be returned to the family or their representative within a reasonable timeframe.

10. Dispute Resolution

In the event of a dispute arising from these Terms or from a care arrangement, both parties agree to first seek resolution through direct, good-faith communication. If the matter cannot be resolved informally, disputes will be referred to mediation before any formal legal proceedings are initiated.

These Terms and any care agreements are governed by the laws of the Kingdom of Thailand. The courts of Chonburi Province shall have jurisdiction over any unresolved disputes.

11. Changes to These Terms

We may update these Terms and Conditions from time to time. Changes will be published on this page with an updated effective date. Continued use of our website or services following a change constitutes acceptance of the revised terms. For significant changes affecting existing care agreements, we will notify affected parties in writing.
